1. Introduction

BNEX is a business communication platform designed to help business owners, traders, suppliers, buyers and other professionals communicate and collaborate through private chats, group chats, voice and video calls, and file sharing. We respect your privacy and aim to protect your personal information. This policy explains what information may be collected, how it may be used and shared, how it is stored, and the choices available to you.

BNEX intends to handle personal data in accordance with applicable Indian laws, including the Digital Personal Data Protection Act, 2023, the Digital Personal Data Protection Rules, 2025, to the extent and from the dates applicable, and other applicable laws. Where consent is required, we will seek it through an appropriate mechanism.

2. Information We Collect

2.1 Account information

When you register or use BNEX, we may collect your mobile number, OTP verification status and authentication records, profile name and photograph (if provided), business name and category, designation, business profile information, account creation date, account status and preferences.

2.2 Messages and shared content

Depending on the features used, we may process individual and group messages, group membership, photos, videos, documents, shared files, message delivery/read status (if enabled), timestamps and communication metadata. Messages and files may be stored on servers to provide message delivery, chat history and synchronisation. Storage and access arrangements depend on the platform’s actual technical design.

2.3 Voice and video calls

We may process caller and recipient identifiers, call start time, duration, connection status, technical information needed to establish calls, and the audio/video streams needed to provide them. Calls will not be recorded or stored as recordings unless a recording feature is introduced, appropriate notice and required consent are obtained, and applicable law permits it.

2.4 Technical and security information

Where necessary, we may collect device type, operating system, app version, language settings, IP address and connection information, login attempts, session information, security events, crash reports, diagnostics and performance logs. We use these details to operate and secure the service, prevent abuse and troubleshoot issues.

2.5 Device permissions and contacts

Installing BNEX does not by itself mean the app will access your contacts, camera, microphone, photos, files or location. Some features require permissions—for example, microphone access for calls and camera access for video calls. We request relevant permissions when needed. If contact discovery is introduced, we will explain how contact information is used before enabling it.

3. How We Use Information

Information may be used to create and authenticate accounts; deliver private and group messages; enable calls; transfer, store and retrieve files; maintain chat history and synchronise supported devices; prevent unauthorised access, spam, fraud and abuse; diagnose errors and improve reliability; respond to support requests and privacy complaints; enforce our terms; comply with legal obligations and lawful requests; and carry out other purposes disclosed to users with an applicable legal basis. We will provide additional notice or seek consent for unrelated purposes where required.

4. Chat Privacy and Encryption

4.1 End-to-end encryption

BNEX has indicated that end-to-end encryption (E2EE) is planned for supported communications. Until E2EE has been implemented, tested and enabled for a specific feature, users should not assume that messages or calls are end-to-end encrypted. Any future claims will be limited to features actually covered by the technical implementation.

4.2 Server storage and metadata

Messages and related content may be stored on servers. Encryption in transit or at rest is not the same as end-to-end encryption. We will not claim that servers cannot access message content unless the implementation supports that claim. Metadata such as account identifiers, group membership, delivery timestamps, call duration, connection information and security logs may still be processed.

4.3 User responsibility

Please take care when sharing commercially sensitive information. Recipients may save, copy, photograph, forward or disclose content they can access, subject to available controls and applicable law.

5. Groups and Business Communication

Your profile may be visible to group members depending on settings. Group members may see content shared with the group, and administrators may have management permissions. Leaving or deleting a group does not necessarily delete copies previously received or saved by others. Check group membership before sharing confidential information.

6. How We Share Information

BNEX does not sell personal data to third parties for their own independent commercial use. We may share limited information with service providers supporting cloud hosting, OTP delivery, push notifications, security and fraud prevention, diagnostics, customer support, file storage and call connectivity. Providers should receive only information reasonably required for their tasks, subject to appropriate safeguards. Information you share is available to intended recipients and authorised participants. We may disclose information where required or permitted by law, valid court order or lawful direction. Relevant information may also be transferred during a merger, restructuring, acquisition or asset transfer, subject to law and safeguards, or shared for additional purposes with valid consent or another lawful basis.

7. Data Storage and Retention

Information may be stored on servers operated by BNEX or its service providers. We aim to retain personal data only as long as reasonably necessary for disclosed purposes and applicable legal requirements. Account information may be retained while an account is active and as lawfully necessary; messages and files according to documented storage/deletion settings; and technical logs for a defined period based on purpose and legal requirements. Data no longer required may be deleted or anonymised where appropriate and technically feasible. Records needed for legal obligations, disputes or security incidents may be retained as permitted or required by law.

Retention schedule: BNEX should publish or document the actual retention periods for account data, messages, files, backups and security logs before launch. Deletion from every backup cannot be promised unless supported by actual systems and procedures.

8. Account and Data Deletion

You may request account deletion by contacting contact@bnex.info. If an in-app deletion feature is available, you may also use that feature. Valid requests will be processed under applicable law and BNEX deletion procedures. Deletion may remove access to account information, message history, groups and files. Content already received or saved by other participants may remain with them, and limited records may be retained where legally permitted or required.

9. Data Security

BNEX takes reasonable steps to protect personal information from unauthorised access, disclosure, alteration, loss and misuse. Depending on the system, safeguards may include encryption in transit and at rest, access controls, secure authentication and session management, security monitoring, incident response, software updates, vulnerability testing, service-provider safeguards, and backup/recovery procedures. Published descriptions should reflect controls actually implemented. No internet service can guarantee absolute security; protect your device and authentication information and report suspicious activity promptly.

10. Personal Data Breaches

If a personal data breach occurs, BNEX will investigate, take reasonable steps to contain and mitigate its effects, and notify affected users and relevant authorities where required by applicable law.

11. Your Rights and Choices

Subject to applicable law and its commencement provisions, you may be able to request information about personal data, correction of inaccurate or incomplete information, erasure where legally available, withdrawal of consent, grievance handling, and nomination of another individual where permitted. Contact contact@bnex.info or call +91 7206770677. We may verify identity before acting and will respond within legally required timelines. Withdrawing consent does not invalidate prior lawful processing and may affect features that depend on the relevant data.

12. Compliance with Indian Laws

BNEX intends to comply, as applicable, with the Digital Personal Data Protection Act, 2023; the Digital Personal Data Protection Rules, 2025; the Information Technology Act, 2000; the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, as amended and applicable; and other relevant legal requirements. Specific obligations depend on the platform’s features, legal structure and role in processing personal data. Policies and practices will be reviewed as applicable requirements take effect or change.

13. Children’s Privacy

BNEX is designed for business communication and is not intended for use by children in violation of applicable law. Where legal provisions concerning children apply, BNEX will implement required safeguards and obtain verifiable parental consent where required, subject to applicable exemptions and rules.

14. International Transfers

Service providers may process or store information in India or other countries depending on the infrastructure used. Transfers outside India will be handled in accordance with applicable Indian requirements. BNEX should identify the actual countries or regions used for processing in its operational documentation.

15. Third-Party Services and Links

BNEX may link to third-party services that have their own terms and privacy policies. BNEX does not automatically control independent third parties’ privacy practices. Relevant information and permissions will be provided where required before enabling integrations.

16. Changes to This Policy

We may update this policy to reflect changes in features, operations, security measures or legal obligations. The updated version will be published on this page with a revised “Last updated” date. Where additional notice or consent is legally required, we will provide it.
